Draft — not legal advice

This document is a working draft and must be reviewed by a lawyer before launch.

1. Agreement

These terms govern use of the Obsidian Tint Pros platform (the “Service”) by businesses (“Customer”, “you”) and their authorised users. By creating an account or using the Service you agree to them on behalf of your business.

2. Accounts

  • You are responsible for your users, their roles and keeping credentials secure.
  • You must provide accurate business information and keep it up to date.

3. Messaging compliance (SMS)

  • You are responsible for having a lawful basis and, where required, express written consent before sending text messages to your customers, as required by the US Telephone Consumer Protection Act (TCPA), Canada’s Anti-Spam Legislation (CASL), carrier rules (CTIA, A2P 10DLC) and any other applicable law.
  • You must honour opt-outs. The Service blocks messages to contacts who replied STOP or are otherwise suppressed, and you must not attempt to work around this.
  • You must not use the Service for unsolicited bulk messaging, prohibited content, or misleading sender identities.
  • You agree to complete any carrier registration (e.g. 10DLC brand and campaign) required for your phone numbers.

4. AI receptionist

  • The AI receptionist quotes only from prices, packages and availability configured in your account. You are responsible for keeping that information accurate.
  • AI output can be wrong. You can review conversations and take over at any time; you remain responsible for commitments made to your customers.

5. Your data

  • You own your customer data. We process it only to provide the Service, as described in our Privacy policy.
  • You can export your data while your subscription is active. After cancellation we delete it within a reasonable period, except where retention is legally required.

6. Fees and payments

  • Subscription fees are billed in advance per the plan you choose. Third-party fees (carrier SMS fees, Stripe processing) are separate.
  • Customer deposits and payments are processed by Stripe under your own connected Stripe account and Stripe’s terms.
  • Wholesale supply orders are governed by the order confirmation and any supply terms provided with it.

7. Acceptable use

No unlawful, harmful or abusive use; no attempts to access other customers’ data or to disrupt the Service; no reverse engineering except where the law allows it.

8. Availability, warranties and liability

[Service levels, warranty disclaimers, limitation of liability, indemnities and governing law — to be drafted by counsel before launch.]

9. Changes and termination

We may update these terms with notice. Either party may terminate as described in your plan; sections that by their nature should survive termination will survive.

10. Contact

[Company legal name, address and contact email — to be completed before launch.]
